Terms and Conditions​​​​​​​

(1) Introduction

a. AVA Prop, limited company registered in the Estonia , grants you ("you" or "the Trader") a limited license to use its services ("the Services"), subject to the terms and conditions outlined in this Agreement.

b. This Agreement is a legally binding contract, and you must carefully review its terms before accessing or using any of AVA Prop’s Services. By accessing or using these Services, you explicitly agree to the terms and conditions set forth in this Agreement.

c. AVA Prop reserves the exclusive right to suspend, modify, amend, or terminate this Agreement at its sole discretion. If any modifications are made to this Agreement, your continued use of the Services after the Effective Date of those changes will signify your acceptance of the revised terms.

(2) Trader Agreement

a. By accessing and using our Services, you confirm that you are at least 18 years old and legally capable of understanding and complying with the terms outlined in this Agreement.

b. If you are using our Services on behalf of a business entity or any third party, you certify that you have the proper authorization to act as a legal representative of that entity. You also acknowledge that you have the authority to accept and abide by the terms of this Agreement on behalf of the business or third party.


(3) Limited License

a. AVA Prop grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable, and royalty-free license to use the Services solely for their intended purpose.

b. This limited license does not grant you any rights to AVA Prop’s intellectual property, including technology, copyrights, trademarks, or trade secrets. You acknowledge that your use of the Services is strictly governed by this Agreement, and any unauthorized use beyond the terms specified is strictly prohibited.


(4) Prohibited Uses

a. You must use the Services in compliance with all applicable laws, regulations, and treaties. Any actions that infringe on the rights of third parties—including but not limited to privacy rights, intellectual property rights, and proprietary rights—are strictly prohibited.

b. The following activities are strictly forbidden concerning AVA Prop’s Services and website:

Scraping, crawling, framing, or unauthorized linking

Aggregating data, hacking, performing denial-of-service (DOS) attacks

Reverse engineering or bypassing technological security measures

c. Sending unsolicited commercial emails via the Services or to other AVA Prop​​​​​​​ Traders is strictly prohibited. While AVA Prop is not responsible for content posted by its Traders and has no obligation to monitor such content, it reserves the right to remove any inappropriate material at its discretion.

d. Any trading strategies that are explicitly prohibited by our partnered Broker are also prohibited under this Agreement. This includes, but is not limited to:

Exploiting errors or delays in pricing or platform execution

Using non-public or insider information for trading

Trading in ways that jeopardize the relationship between AVA Prop and its broker or could lead to trade cancellations

e. If AVA Prop identifies any prohibited trading activities, your participation in the program will be terminated, and any fees paid will not be refunded. Before receiving a funded account, both AVA Prop and its Broker will review your trading activity to ensure compliance. If any violations are detected, you will not be granted a funded account.


(5) Account Creation and Security

a. To register as a trader, you must provide personal information, including but not limited to your full name, email address, phone number, date of birth, and a secure username and password.

b. Your account is strictly personal and non-transferable. You may not purchase or acquire an account on behalf of another person. It is your responsibility to maintain the confidentiality of your login credentials. If you suspect unauthorized access, you must notify us immediately.


(6) Purchases and Refunds

a. AVA Prop offers various services, subscriptions, and access to exclusive platform features for a fee. Prices and availability are subject to change without prior notice. Transactions may be completed directly through AVA Prop​​​​​​​ or a third-party affiliate.

b. All purchases are final and non-refundable. If additional documentation is required for verification, you must provide it within 24 hours. Failure to do so may result in the revocation of your access to the Services.

c. AVA Prop reserves the right to close inactive accounts (no trades within 30 days) without a refund.

d. Any customer who disputes charges improperly or requests chargebacks through their bank will be permanently banned from the platform.


(7) Responsible Trading

a. AVA Prop promotes ethical trading practices and strictly prohibits fraudulent or gambling-like behavior. Traders must adhere to risk management principles and responsible trading strategies.

b. The following strategies are strictly prohibited and may result in immediate account closure and loss of funds:

Hedging

Martingale

Tick scalping

Reverse arbitrage trading

Latency arbitrage trading

Grid trading

High-Frequency Trading (HFT)

c. Traders must not risk 100% or more of their drawdown limits in open trades. Violations may result in account suspension, payout reduction, or termination.


(8) Trading Rules

a. Traders must comply with the following rules:

Max Relative Drawdown Rule (1-Step Evaluation): Account balance/equity must not fall below 5% of the starting day balance.

Max Total Loss (2-Step Evaluation): Account balance/equity must not fall below 11% of the starting balance.

Minimum Trading Days: A trading day is only counted if the trader achieves at least a 0.5% gain.

Inactivity Rule: Accounts inactive for 30 days may be terminated without a refund.

b. Traders must maintain a logical and consistent approach to risk management. Large fluctuations in risk exposure or drastic changes in trading style may result in penalties.

c. Automated trading strategies such as Martingale, arbitrage trading, and latency trading are strictly prohibited.


(9) Guidelines

a. Upon registration, AVA Prop​​​​​​​ provides traders with access to its official trading guidelines. These guidelines are subject to change at AVA Prop’s discretion.

b. Becoming a trader with AVA Prop does not guarantee future employment or financial compensation.


(10) Trademarks & Intellectual Property

a. All trademarks, trade names, logos, and intellectual property on AVA Prop’s platform are the exclusive property of AVA Prop or its licensors. Unauthorized use is strictly prohibited.

b. Accessing AVA Prop’s website does not grant any rights to use its intellectual property.


(11) Disclosure Statement

a. Trading involves significant financial risk, including leverage, market volatility, and limited regulatory protection. Traders should carefully assess their risk tolerance before engaging in financial markets.

b. Internet-based trading systems carry potential risks, including system failures. Avaprop is not responsible for technical issues but implements safeguards to minimize disruptions.


(12) Term and Termination

a. This Agreement begins upon your purchase of an AVA Prop​​​​​​​ Service and remains in effect until terminated by either party. AVA Prop reserves the right to terminate access to its Services at any time without prior notice.


(13) Assignment

a. You may not transfer your rights under this Agreement to any third party. However, AVA Prop retains the right to transfer its rights and responsibilities.


(14) Waiver

a. No part of this Agreement shall be waived or modified unless documented in writing and signed by the relevant parties.


(15) Entire Agreement

a. This Agreement constitutes the full understanding between AVA Prop and the Trader, superseding all prior agreements, whether written or verbal.
